Ndileka Mthembu and Sindiso Sibanda — founding partners of Mthembu Sibanda & Associates
The founding partners Ndileka & Sindiso

Our story.

Founder Ndileka Mthembu set up MS & Associates with a question she couldn't shake: why does world-class legal service so often feel cold, transactional, and out of reach for the people who need it most?

That question became the founding brief for the firm. Together with partner Sindiso Sibanda — who brought commercial and operational depth from outside the legal industry, and now heads the firm's Litigation Division — they set out to build the kind of practice they wished had existed when they were starting out: senior, attentive, fairly priced, and genuinely accountable.

"The law is not abstract. It is the architecture of how people live, love, build, and rest. The firm's job is to make that architecture work for the client — not the other way around."

What we believe

We believe a great matter team is small, senior, and fully briefed. We believe the client should never have to chase a phone call. We believe fees should be predictable and explained before work begins. We believe that being a proudly Black-owned, BBBEE-certified, partner-led firm in South Africa is not a marketing line — it's a perspective that informs how we listen, who we serve, and how we build.

What we don't do

We don't take every matter that comes through the door. We don't bill in opaque six-minute increments without explanation. We don't hand your file to a stranger and disappear. We don't promise outcomes we cannot deliver. We are a boutique firm by choice, because volume and care don't mix.

Where we work

Our principal office is in Bryanston, Johannesburg, with a secondary presence at New Court Chambers in Pretoria Central — placing us within walking distance of both the Pretoria High Court and the Master's Office. We are admitted in the High Court of South Africa and act in matters across Gauteng and the rest of the country through our correspondent network.

What guides us

Three principles. Held without exception.

01

Senior accountability

Every matter is led by an admitted attorney from intake to resolution. No junior carries your file in silence, and no instruction is acted on without senior review.

02

Transparent fees

Every engagement begins with a written letter setting out scope, fee estimate, and milestones. If costs change, we tell you before the work begins — not when the invoice lands.

03

Honest counsel

We tell you when you have a strong case, when you don't, and when settling is wiser than fighting. The job is your outcome, not our fee.

Director

Ndileka Mthembu

Ndileka is a seasoned legal professional with over seven years of progressive experience in corporate law and litigation. Her career began as a Candidate Attorney at Mkhize Attorneys, followed by Viljoen Attorneys as a Legal Advisor specialising in family law. She went on to serve as Attorney and Head of Department at Bokwa Incorporated and Velile Tinto & Associates, where she expanded into commercial litigation and corporate advisory work — analysing legislative impacts on business operations, drafting comprehensive legal opinions, and managing high-stakes litigation matters.

The culmination of her professional growth came with the establishment of MS & Associates, where she serves as Director. In this capacity, she has merged legal expertise with executive leadership — overseeing firm operations, strategic case management, compliance oversight, team development, and the mentorship of junior attorneys, while maintaining an active corporate law practice.

What distinguishes Ndileka's practice is the ability to combine technical legal mastery with practical business acumen. Her particular strengths lie in corporate compliance, litigation strategy — balancing assertive advocacy with alternative dispute resolution — and operational leadership. Her approach consistently emphasises solutions that are legally sound, commercially viable, and strategically aligned with client goals.
